Grievance GRANTED. The issue was whether the Employer breached Article 47 by disallowing Grievant's request for disability leave. The Grievant's personal physician felt that if Grievant returned to work, it could worsen his condition. The Arbitrator though the opinion of Grievant's personal physician was more relevant than the opinion of the physicians used as witnesses by the Employer because those physicians had never examined Grievant and did not know his medical history.
