Grievance MODIFIED. The Arbitrator found that the Employer should have filled the radio operator's contract pursuant to Articles 17 & 18. Article 14, which allows the Employer to use seasonal ODOT employees to fill in positions, does not permit the Employer to avoid filling vacancies with permanent full time employees. But, Grievant was only entitled to hold the position up until the Employer took the appropriate steps to change the organization structure and replace Radio Operators with Radio Technicians. Grievant is entitled to back pay and benefits from the date her grievance was filed through the date the Department posted the vacancy for the Radio Technician. ** See also: 31-09-911
