The grievance was DENIED. The Grievant was a Treatment Plant Operations Coordinator at the Hockingì Hills facility of the Department of Natural Resources. His position wasì abolished on November 6, 1991. Grievant had been working for the Departmentì of Natural Resources since 1975. The position had a minimum licensingì requirement for the class and type of plant operated. A Treatment Plantì Operator Aide was hired and trained by Grievant and an Engineering fieldì representative. The Aide had the required licenses and became a Treatmentì Plant Operator in 1988. On April 17, 1986, the Ohio EPA imposed new,ì stricter regulations. Training to obtain the appropriate license was offeredì to the Grievant and the new Operator, but the Grievant did not avail himselfì of the training.
