Grievant, a Therapeutic Program Worker, was terminated for neglect of duty for failure to show up or call off work four days in June and five days in August for a total of nine times in a three month period. The State clearly established that the Grievant engaged in teh misconduct as charged. Such misconduct is recognized under teh attendance rules and under general principles of just cause, as conduct for which discipline up to and including discharge can be appropriate.
