DENIED. Grievant, a therapeutic program worker with the Western Reserve Psychiatric Hospital, was removed for absenteeism. Grievant, because he agreed to participate in an EAP, had an original removal held in abeyance. Because of subsequent absences as well as non-performance of conditions of his involvement in the EAP, grievant was terminated. The Arbitrator held the Employer followed proper procedure in entering into the EAP agreement. The Employee failed to to fulfill the terms of the EAP Agreement and termination was for just cause.
