AWARD NO: 0576 (DRAFT) FOLMER: The Arbitrator denied the grievance. There may have been another vehicle, but there is no corroboration and the OSP did not amend their report. Grievant was familiar with the road and the OSP found driver inattention was the cause of the accident. The Arbitrator found the discipline reasonable and in line with ODOT past practices. BEATTY: The Arbitrator denied the grievance. The fact that co-workers could have been subpoenaed to support Grievant's claims but were not severely weakened her case.
