DENIED. This was the grievant's second discharge; the first was grounded on substance and/or alcohol dependency that impaired her job performance. This first discharge was withdrawn on a last-chance agreement under which the grievant was supposed to correct her problem through an Employee Assistance Program (EAP). On August 17, 1990, the grievant was scheduled to work a shift that began at 11:00 p.m. A Sergeant decided to investigate, drove to the grievant's house, and determined that she was unfit to report to work because of alcohol intoxication. The Arbitrator found the grievant to be in violation of the Last Chance Agreement and upheld removal.
