Grievance MODIFIED. Removal reduced to a 90 day suspension. The Arbitrator held that the Employer was precluded from disciplining Grievant for an improper sexual relationship while on duty because the incident was more than two years old. Discipline for lying during the investigation was appropriate, but the offense fell short of establishing just cause for discharge. The Arbitrator found that the personal and emotional aspect of the situation were mitigating factors.
