DENIED. Grievant, who had an interim appointment, bid on a position and was rejected in favor of someone from outside the bargaining unit. Since the position was, in effect, a demotion, the issue was whether Article 28 covered demotion. An examination of the notes of the negotiations indicated that it was discussed, and the motion of covering demotions was rejected; therefore the grievance was denied since existing law governed matters upon which no agreement had been made.
