DENIED. Grievant, a Psychiatric Attendant at COPH, was removed for incompetence, namely failure to report a client's injury. The Union argued that the removal was not for just cause because other employees who violated similar rules were not disciplined as harshly. Management maintained that given the Grievant's prior discipline and the nature of his act, his discharge was for just cause. Employer proved just cause and the Union failed to prove its defense of disparate treatment.
