GRANTED. Grievant received a two day suspension after he was observed driving in an erratic manner while on patrol. Previously, the patrol gave the grievant a written reprimand for speeding. The grievance was granted for two reasons. First, the incident was caused by the grievant's narcolepsy, which had been successfully treated. Second, the disciplinary action was not initiated until nearly 4 months had passed; during that period, no similar incident occurred. The Arbitrator held therefore, that the discipline served no corrective purpose and granted the grievance. A claim of racial discrimination was held to be unproven.
