MODIFIED. Grievant was removed for allegedly providing a youth with a hiding place following his escape from a DYS facility. The grievant argued that the state failed to prove that such harboring occured and the arbitrator concurred. However, because it was obvious that a closer then normal relationship did occur, the arbitrator did not order reinstatement. Instead, back pay was ordered from the time of the removal to the grievant's hire date with another agency, plus accrued seniority that otherwise would be lost. An additional factor against reinstatement is the grievant's likely ineffectiveness in her old position and her higher income in her new position.
