DENIED. The Grievant protested management's change in his scheduled work hours from 7:00 to 3:45 to 8:00 to 4:45. The union alleged this was done to avoid payment of overtime, and that since the grievant had maintained his same schedule for 10 years, the employer was bound to honor it. The Arbitrator determined that the length of time worked on the schedule did not constitute a fixed schedule. He held that, since the office serviced clients from 8:00- 5:00, the grievant's fixed schedule should logically coincide with those hours. Further, in accord with Article 5 - Management's Rights - the employer could determine what hours would best serve the clients. Finally, the Arbitrator determined that the schedule had not been changed to avoid payment of overtime but to fulfill operational needs, as the grievant was not required to work more than a 40 hour week.
