DENIED. Grievant, an employee of a State liquor store, was removed for opening and consuming alcohol at a State store. A co-worker witnessed the act and reported it to Management. The Union argued that the witness testified only because she wanted his position. Also, discipline was not progressive. Management maintained that this particular offense warranted removal and Grievant's behavior violated the central tenents of the D.O.L.C. Grievant not only drank on the job, but he tampered with material entrusted to the D.O.L.C. and allowed it to be placed at public disposal. The Arbitrator found that wherever liquor consumption is at issue, potential for an EAP must be addressed. However, Grievant denied a need for EAP and rejected such a solution.
