DENIED. The Grievant was discharged for negligence involving accidents in the state vehicle assigned to him. The Union contended that tenets of progressive discipline had not been followed; and therefore, the removal was without just cause. The Arbitrator held that since the Grievant had prior warnings that he should correct his behavior, he was on notice that further accidents could lead to his removal. The Arbitrator also determined that the employer's investigation was sufficient to uphold a just cause finding. The Arbitrator said the Grievant had "made himself a liability... which the Arbitrator cannot expect the Employer to sustain."
