MODIFIED. Grievant was terminated for insubordination and unauthorized absences. The unauthorized absences resulted from severe family and health problems. In light of the circumstances which led the grievant to take leave without approval, the arbitrator held that the termination of the Grievant did not reflect "the severity of the violation" by her. Hence, the state failed to prove by clear and convincing evidence that the Grievant was discharged for "just cause".
