The Grievance was GRANTED. The Grievant was granted vacation time and unpaid leave to visit his ill sister in Peru. While in Peru he contracted Typhoid Fever. He notified his wife who notified LCI. When he relapsed, he was ordered to bed rest in Peru. This delayed his return to work. He did not inform the institution. The arbitrator held that the grievant circumstances warranted mitigation. Just Cause did not exist for discipline.
