Grievance DENIED. The Arbitrator used the clear and convincing evidence standard and rejected the Union's contention that there was no just cause for discharge because Grievant was not indicted by a Grand Jury. The Arbitrator held that poor procedures and inadequate supervision do not excuse an attempt to deposit a state check in a private bank account. Grievant's actions were dishonest and constituted a serious offense which merited removal.
