Grievance SUSTAINED. The Arbitrator found the Employer to be bound by past practice and Section 41.03, therefore, it must offer all on-duty work to bargaining unit physicians. The Employer was forbidden from contracting out such work so long as bargaining unit physicians were willing and able to perform the work. Bargaining unit physicians shall be made whole.
