Grievance Information Detail

The Grievance was GRANTED in part and DENIED in part. Grievant was suspended for 10 days following two accidents involving the vehicle he was driving; one involved another car and resulted in injury to its driver. The grievant argued that the accident was due to an unsafe vehicle which the contract prohibited. The arbitrator adduced that the accidents were in part due to operator error; therefore, discipline was appropriate. However, 10 days was judged to be too harsh. For that reason, the suspension was reduced to a total of 4 days based on ODOT's disciplinary grid.
