MODIFIED. Grievant was removed following a conviction for aggravated trafficking of cocaine. The grievant was on layoff at the time of the convinction; an arbitrator's ruling in the meantime ordered the grievant to be reinstated and she was placed on administrative leave when she reported for work. The Arbitrator found that some similarly situated employees had been treated differently; however, there is a substantial job nexus between the grievant's position as a nurse's aide and the drug trafficking conviction. The grievant was ordered reinstated on a probationary basis for one year without back pay.
