DENIED.  AWARD: 0131 The grievants filed because, as members of an Ohio State Highway Patrolì post at the lowest level of staffing requirements, they were denied vacationì and holiday leave and denied the ability to trade shifts to a time when oneì could take time off. The FOP argued a disparity between day and night shifts for procedures inì gaining leave approval. It was argued the Employer could transfer someone toì fulfill requirements. The Employer maintained the grievances attacked the relation betweenì Management and Employee rights; that staffing requirements and differencesì between shifts' requirements justified the procedures for leave approval. The Arbitrator found no firm rules for obtaining leave approval, and thatì both day and night shifts had limitations on their ability to use leave.
