The Grievance was DENIED. The Grievant received a verbal reprimand for "operating his assigned patrol car to his home on an off day without obtaining prior permission," which was in direct violation of posted policy. Subsequently, the Grievant was reassigned another patrol car. Although the Grievant was still allowed to use the car and could drive the unit home, he filed the grievance claiming that relieving him of the first car was punitive. The Arbitrator held that the issue was arbitrable, in separating the assignment of a car from the prior verbal and non-arbitrable reprimand. The contract language fails to indicate that the parties provided in the agreement a specific right to be assigned to a particular vehicle. Such decisions remain within the express and residual authority of management.
