The grievance was GRANTED. On July 20, 1986, the Ohio Department of Mental Retardation andì Development Disabilities permanently laid off several entire classificationsì of employees at the Broadview Development Center in Broadview Heights, Ohio. ì In light of the layoff options presented by the contract, Broadview employeesì feel they were illegally targeted. The Employer argued that because Appendix J (Geographical Jurisdictions)ì of the Contract Between the State of Ohio and OCSEA (hereinafter "theì Contract") was not known to be in existence at the time of the layoffs, itì was appropriate and in compliance with Article 18, Section 18.01 (Layoffs) toì layoff the employees.
