DENIED. The Union alleged that the introduction of sign-in/sign-out sheets by the Department of Health violated the contract. The Union alleged that the policy was adopted without proper notice, constituted a "defacto" time clock and was "unreasonable." The first two arguments were rejected. With respect to the third, the arbitrator found evidence of inconsistent administration of the policy. However, such poor administration does not mean that the rule is improper. The grievance was denied. The arbitrator held in particular that in order to show notice, a mere posting is sufficient and the employer need not demonstrate actual receipt by the Union.
