MODIFIED. Grievant was suspended for 30 days then terminated. The 30-day suspension involved neglect of duty and the termination was for insubordination and neglect of duty. With regard to the suspension, the arbitrator found that disparate treatment took place because another employee involved in the same incident received a lesser suspension. Thus the suspension was reduced to 10 days. Because the suspension was reduced, the grid in use at MR/DD required that the removal be modified as well. The arbitrator, citing the serious nature of the miscondcut (involving risk to the health of a client)reinstated the grievant without back pay.
