The Grievance is DENIED. The Arbitrator upheld the removal, finding the Grievant's excuse that he was confused as to his proper date of return to work suspect. The Arbitrator viewed as slim the prospects for improvement in Grievant's attendance in that he was previously given the opportunity to undergo treatment for his alcoholism and failed to take full advantage of it. The Arbitrator concluded that Management's failure to take disciplinary action on several occasions indicated patience and a willingness to help Grievant.
