Grievance DENIED. The arbitrator found that the State acted within the 45 day period required by the contract, and that the Union's failure to assert before arbitration the protest about this constitutes a waiver. Also, the inmates' written statements were admissable, as were their polygraph tests in order to demonstrate their credibility. The arbitrator found clear and convincing evidence that Grievant engaged in sex acts with inmates and threatened another inmate to remain silent.
