Grievance GRANTED. The Arbitrator held that an "offer" of opportunity for overtime is predicated upon the Trooper being "qualified" for such overtime according to Section 61.03 of the contract. When the Employer knows that the employee is not available for overtime because of vacation scheduled in advance, the employee is not qualified for overtime and cannot be charged for refusing that overtime. The Arbitrator noted that this decision does not preclude the Employer from offering overtime to troopers who are on vacation.
