AWARD: 0007 ISSUES: Article 31.01 of the Agreement states in part, "Members of theì bargaining unit may be required to live within thirty (30) miles of theirì assigned post." The Union contended that the employee was moving within a 30ì mile radius (as measured on a map) and was in compliance with Article 31.01.ì The Partol argued that the Article referred to road miles since troppersì respond to work assignments and other incidents by using established road or land miles. HOLDINGS: The Arbitrator found that a Trooper can not be penalized for theì road layout by the Highway Department and that the wording of the Article wasì somewhat ambiguous. Therefore, the Arbitrator found that the Article meansì that a Trooper's residence must be inside of thirty (30) miles from his work site as measured by the radius method.
